Nitrogen and Real Estate Development: The Facts
The Netherlands is home to over 160 Natura 2000 areas—protected nature zones under European law. These areas suffer from excessive nitrogen and ammonia deposition. Nitrogen acts as a fertilizer, allowing fast-growing species like nettles to thrive, while more vulnerable species disappear. This disrupts biodiversity, prompting strict regulations to protect these ecosystems.
For every new real estate development, it must be demonstrated that the project will not have a significant negative impact on Natura 2000 areas. Even a minimal increase in nitrogen emissions can trigger a permit requirement. This applies almost everywhere in the Netherlands and therefore affects nearly all real estate developments, including logistics projects.
What Nitrogen Legislation Means for the Real Estate Sector
The Council of State ruling of December 18, 2024, has further complicated the situation. Previously, developers could rely on internal offsetting—replacing older buildings with new, lower-emission ones—to proceed with projects. However, this ruling now requires a nature permit even for internal offsetting.
The key change is that internal offsetting can no longer be used in the preliminary assessment (the "voortoets") to avoid a permit. Instead, it must be evaluated in a full appropriate assessment, and a permit is mandatory. These permits are issued by provincial authorities, many of which are currently facing capacity shortages and unclear policy framework.
